Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Indemnification
You agree to defend, indemnify and hold harmless Asteroid Property Management, Inc. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

In no event shall Asteroid Property Management, Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Information Collection and Use
We collect several different types of information for various purposes to provide and improve our Service to you.
Data and records belonging to our customers must be retained per our product terms and conditions and/or specific contractual agreements.
By default, we save and can access all security documentation and audit trails for a minimum of seven years, unless otherwise specified by specific regulations, or contractual agreement.
We clone production data to QA machines for testing and faster issue reproduction for masquerading real users. The cloned data is masked to protect PII data of the Property Manager’s tenants. You, the customer, authorize our use of cloned production data. The data will be accessed on a need-to-know basis.
Types of Data Collected
Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Phone number
- Address, State, Province, Zip/Postal code, City
- Cookies and Usage Data
We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.
Usage Data
We may also collect information on how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. Moreover, to enhance our understanding of user engagement and improve our Service's quality, we utilize a software service called "Full Story," which helps us analyze and interpret user interactions within our software.
Location Data
We may use and store information about your location if you give us permission to do so ("Location Data"). We use this data to provide features of our Service, to improve and customize our Service.
You can enable or disable location services when you use our Service at any time by way of your device settings.
Tracking & Cookies Data
We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information.

- Confidential/Restricted Data:
Generalized terms that typically represent data classified as Sensitive or Private, according to the data classification scheme defined in this policy. - Internal Data:
All data owned or licensed by you, the client. - Public Information:
Any information that is available within the public domain.
We reserve the right for Ender employees to exchange client information classified as Internal Use or Confidential/Restricted over Slack. Additionally, with the consent of the client, we reserve the right to reclassify Confidential/Restricted data as Internal use for our team to quickly solve client issues.
Data Classification Scheme
Data classification, in the context of information security, is the classification of data based on its level of sensitivity and the impact to you, the client, should that data be disclosed, altered, or destroyed without authorization. The classification of data helps determine what baseline security controls are appropriate for safeguarding that data. All data should be classified into one of the three following classifications.
Confidential/Restricted Data
Data should be classified as Restricted or Confidential when the unauthorized disclosure, alteration, or destruction of that data could cause a serious or significant level of risk to you, the client, or your customers. Examples of Sensitive data include data protected by state or federal privacy regulations (e.g. PHI & PII) and data protected by confidentiality agreements. The highest level of security controls should be applied to Restricted and Confidential Data:
- Disclosure or access to Restricted and Confidential data is limited to specific use by individuals with a legitimate need-to-know. Explicit authorization by the Security Officer is required for access to because of legal, contractual, privacy, or other constraints.
- Must be protected to prevent loss, theft, unauthorized access, and/or unauthorized disclosure.
- Must be destroyed when no longer needed. Destruction must be in accordance with Company policies and procedures.
- Will require specific methodologies, procedures, and reporting requirements for the response and handling of incidents.
Internal Use Data
Data should be classified as Internal Use when the unauthorized disclosure, alteration, or destruction of that data could result in a moderate level of risk to you, the client, or your customers. This includes proprietary, ethical, or privacy considerations. Data must be protected from unauthorized access, modification, transmission, storage or other use. This applies even though there may not be a civil statute requiring this protection. Internal Use Data is restricted to personnel who have a legitimate reason to access it. By default, all data that is not explicitly classified as Restricted/Confidential or Public data should be treated as Internal Use data. A reasonable level of security controls should be applied to Internal Use Data.
Public Data
Data should be classified as Public when the unauthorized disclosure, alteration or destruction of that data would result in little or no risk to you, the client, and your customers. It is further defined as information with no existing local, national, or international legal restrictions on access or usage. While little or no controls are required to protect the confidentiality of Public data, some level of control is required to prevent unauthorized alteration or destruction of Public Data.
Assessing Classification Level and Labeling
The goal of information security, as stated in the Information Security Policy, is to protect the confidentiality, integrity, and availability of Corporate and Customer Data. Data classification reflects the level of impact to you, the client, if confidentiality, integrity, or availability is compromised. If a classification is not inherently obvious, consider each security objective using the following table as a guide. All data are to be assigned one of the following four sensitivity levels:

Our Policy on "Do Not Track" Signals under the California Online Protection Act (CalOPPA)
We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.
You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
Service Providers
We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.

Behavioral Remarketing

Dwolla Verified Customer Record/Customer Record Language
In order to use the payment functionality of Ender's application, you must open a "Dwolla Platform" account provided by Dwolla, Inc. and you must accept theDwolla Terms of Service and Privacy Policy. Any funds held in the Dwolla account are held by Dwolla's financial institution partners as set out in the Dwolla Terms of Service. You authorize us to collect and share with Dwolla your personal information including full name, date of birth, social security number, physical address, email address and financial information, and you are responsible for the accuracy and completeness of that data. You understand that you will access and manage your Dwolla account through our application, and Dwolla account notifications will be sent by Dwolla. We will provide customer support for your Dwolla account activity, and can be reached via our websitehttps://ender.com, or by emailing support@ender.com
Receive Only Language
"You expressly authorize Ender's service provider, Dwolla, Inc. to originate credit transfers to your financial institution account. You authorize Ender to collect and share with Dwolla your personal information including full name, email address and financial information, and you are responsible for the accuracy and completeness of that data. Dwolla's Privacy Policy is available here.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

Cancellation of the SMS Service
To terminate the SMS service, reply "STOP" to any message from Ender. A confirmation SMS will be sent upon receipt, ceasing further messages. To re-enable, reply "START" in the existing message thread.

Carriers are not liable for delayed or undelivered messages.
